When an error occurs, the consequences for pharmacists can be quite
daunting. Human considerations apart, the costs of investigation,
legal defence, and, if necessary, compensation could be well beyond
the reach of the average pharmacist. Bearing in mind that the consequences
can go way beyond an argument with a patient over compensation,
it is vital that, if at all possible, you fight to defend your reputation.
A successful defence of a civil claim for compensation could prevent
further action in the form of a Professional or Employment Disciplinary
Action being taken and it could even prevent a prosecution.
Wherever possible, PDA will explore the relationship between the
patient, the prescriber, the employer and you the pharmacist in
a way that ensures that your interests are not overlooked. If blame
can be apportioned elsewhere the PDA will act on your behalf to
ensure that you are not treated unfairly.
