The claimant’s case is a lengthy judgement which includes:
- Worker status
- Locum using a limited company
- The self-employed relationship
- Whistleblowing
- A toxic culture
The judgement, in this case, states that the claimant was disabled during the relevant period. The judgment also states that the claim of harassment related to the claimant’s disability in respect of an incident on 7 January 2020, brought pursuant to section 26 EqA, is well-founded and succeeds.
However, the claims that the claimant was subjected to detriments pursuant to section 43B ERA are not well-founded and are dismissed, while those which relate to events in August 2019 are struck out as being brought out of time.
